今天是七月十三日,小弟我依然是坐緊監,為何今天我會有這一段影片呢,原因是今天是劉曉波先生的死忌,不經不覺已經是四年了。
大家都知道,劉曉波是我們中國第一位,亦是唯一獲得諾貝爾和平獎的人。我記得當年2008年,他是有份撰寫零捌憲章的,是很多年前的事。他當年的訴求其實很簡單,對於香港來說,甚至乎是偏向平實保守,他只是希望中國能夠有一個體制內和平的政治改革,希望能夠使到中國整個民主社會或是公民社會可以進步和發展。這只是一篇相對溫和憲章,但在當年卻遭到共產黨的全面打壓,大家便知道共產黨所懼怕的,並不是什麼分裂勢力、暴力或是外國力量介入,它們最懼怕是人民的良知。亦因此過往每年的今天,我和長毛和社民連等人,無論下多大雨都總會去中聯辦燃點燭光,去悼念劉曉波先生,但當然今天我沒辦法做到,我亦不會清楚在監獄外的朋友能否做到,但我仍希望各位朋友今天至少能穿上黑衣,用自己的方法去燃點燭光,去悼念劉曉波先生,甚至乎若您今天有時間的話,您可以上網了解一下零捌憲章的內容,或是重溫一下劉曉波先生的事蹟,他生平除了零捌憲章外還有很多貢獻,當年他也在天安門廣場內。
現在回想劉曉波先生的遭遇也很唏噓,其實除了劉曉波先生外,這麼多年來還有無數的維權人士和維權律師,在大陸被失踪、被監禁、被自殺、被滅亡,無論您覺得您是香港人也好,還是覺得您是中國人也好,或是覺得自己是世界公民也好,無論您價值觀如何,只要您也是追求或是擁抱自由、民主、公義的說,我們希望各位皆可以出一分力去悼念劉曉波先生,因為他是一個非常標緻性的人物,他臨終時雖然罹患癌症,但他一直以來也沒有放棄,亦沒有屈服。每次談到這個話題,心情也會很唏噓。
我希望能夠很快可以放監出來,可以和大家在街頭上見,亦都希望可以再次為劉曉波先生,和那些為民主運動而犧牲的人,聊表心意和悼念。

Today is the 13th of July and I am still in prison. The reason why I have this video today is that today is the anniversary of the death of Mr LIU Xiaobo. Time flies and it has been 4 years already.
As we all know, LIU Xiaobo was the first and only person in China to be awarded the Nobel Peace Prize. I remember that in 2008, he had a part to play in writing the Charter 08, which was many years ago. He only hoped that China could have a peaceful political reform within the system, and that the whole democratic society or civil society in China could progress and develop. The content of the charter was rather mild, yet it was heavily suppressed by the communists. We all know that the regime fears not separatist forces, violence, or foreign forces, but the people's conscience. That is why every year on this day, Long Hair, the League of Social Democrats and I would always go to the Liaison Office to light a candle in memory of Mr Liu Xiaobo, no matter how heavy the rain was. But of course I can't do that today, and I'm not sure if my friends outside the prison can either, however I still hope that you can at least wear black today and light a candle to remember Mr. Liu Xiaobo. If you have time today, you can go online and learn about Charter 08, or you can revisit the story of Mr Liu Xiaobo, who made many contributions in his life apart from Charter 08, in fact he was in Tiananmen Square back then too.
It is saddening to look back on what happened to Mr LIU Xiaobo. In fact, apart from Mr LIU Xiaobo, there are countless other human rights activists and lawyers who have been disappeared, imprisoned, suicided or killed in the Mainland over the years. Whether you feel you are a Hong Kong citizen, a Chinese citizen, or a global citizen. No matter your values, as long as you are in pursuit of freedom, democracy, and justice, we hope you can all pay your respects to Mr Liu Xiaobo because he was a very exemplary figure. He was dying of cancer, but he never gave up. Whenever I talk about this subject, I feel very sad.
I hope to be released from prison soon and be able to meet you all on the streets. I also hope that we can once again pay tribute to Mr Liu Xiaobo and those who sacrificed their lives for the democratic movement.

*【就特區政府引用國安法第22條展開大規模拘捕行動的聲明】*
超過50名民主派議員、社運人士及律師,因組織及/或參與已延期的2020年立法會換屆選舉前的初選,而被指控觸犯國家安全法第22條下,有關顛覆罪的罪行。我們 - 即下列堅定相信基本法和法治的聯署人 - 以個人名義,對上述事宜表達深切關注。
在星期三(6日)的記者會上,警務處國家安全處高級警司李桂華證實,警方在是次行動中,在獲得搜查令的情況下搜查了72個處所,當中包括一間律師事務所。國安法第22條訂明,構成罪行的基本元素是「以武力、威脅使用武力或者其他非法手段」。然而當局在記者會上未能完滿地解釋,在該次初選並沒有出現任何暴力或非法行為的情況下,他們是基於甚麼原因引用第22條採取拘捕行動。
任何人不論政見均有權參與公共事務,是《公民與政治權利國際公約》第25條確保的權利,亦受《香港人權法案條例》第21條保護。這項權利,對發展民主管治和法治均發揮關鍵的作用。因此,我們強烈譴責任何打壓和平表達《基本法》賦予市民的基本人權的行為。
《約翰奈斯堡關於國家安全、言論自由和獲取信息自由原則》(U.N. Doc. E/CN.4/1996/39) 第二條訂明:「一種以國家安全為理由所實行的限制是不合法的,除非其真正的目的和可以 證實的效果是為了保護國家的生存或領土完整免遭武力或武力威脅的侵害, 或者保護其對武力或武力威脅反應的能力,無論這些武力或武力威脅來自外 部,如軍事威脅,還是來自內部,如煽動以暴力推翻政府。」2003年3月,特區政府嘗試按照《基本法》第23條制訂國家安全法時,當時的保安局仍然正面地肯定國家安全立法需符合《約翰奈斯堡原則》。
我們促請特區政府解釋,是否已經放棄《約翰奈斯堡原則》內的適用原則,以及《基本法》訂明保障的基本權利,包括表達和集會的自由。
作為律師,我們同時深切關注搜查律師事務所可能會違反《基本法》第35條訂明法律專業保密的基本權利,即「香港居民有權得到秘密法律諮詢、向法院提起訴訟、選擇律師及時保護自己的合法權益或在法庭上為其代理和獲得司法補救」。我們急切呼籲當局自我約束,確保法律專業保密權得到充份保障,以及全面維護所有香港市民參與政治的權利。

【Statement on the Mass Arrest under Article 22 of the National Security Law】
We, the undersigned, as legal practitioners who firmly believe in the Basic Law and the rule of law are deeply concerned that more than 50 pro-democracy lawmakers, activists and lawyers, were arrested yesterday for alleged subversion under Article 22 of The Law of the PRC on Safeguarding National Security in the HKSAR (“NSL”) for organising and/or participating in a primary election for candidates in the 2020 Legislative Council election.
At the press conference on 6 January, Senior Superintendent Steve Li confirmed that the Police had searched 72 premises with a warrant, including a law firm. No satisfactory explanation, however, was given by the authority at the press conference as to why Article 22 of the NSL was invoked in respect of these activities, when that provision expressly requires as an essential element of the offence the use of “force or threat of force or other unlawful means”. The organisation and conduct of the primary election did not involve any violence or other unlawful acts.
The right to participate in public affairs, irrespective of one’s political opinion, is enshrined under Article 25 of the International Covenant of Civil and Political Rights and also protected under article 21 of the Bill of Rights Ordinance (Cap.383). It also plays a crucial role in the promotion of democratic governance and is fundamental to the rule of law in Hong Kong. Therefore, we strongly oppose and condemn any attempts to suppress peaceful exercise of the fundamental human rights enshrined in the Basic Law.
We note that back in March 2003, when the NSL was introduced, the Security Bureau still acknowledged the need for the national security legislation to be consistent with the Johannesburg Principles. Principle 2 of the Johannesburg Principles on National Security, Freedom of Expression and Access to Information, Freedom of Expression and Access to Information (U.N. Doc. E/CN.4/1996/39) provides that “A restriction sought to be justified on the ground of national security is not legitimate unless its genuine purpose and demonstrable effect is to protect a country's existence or its territorial integrity against the use or threat of force, or its capacity to respond to the use or threat of force, whether from an external source, such as a military threat, or an internal source, such as incitement to violent overthrow of the government.”
We call upon the Government to explain whether it has abandoned any due regard to the Johannesburg Principles and the fundamental rights guaranteed under the Basic Law, including the freedom of expression and assembly.
As lawyers, we are further troubled by the search of a law firm, which could violate the fundamental right of residents to legal advice as set out in Article 35 of the Basic Law. We urgently urge the authorities to exercise restraint, to ensure effective protection to legal professional privilege, and to fully uphold the right to political participation for all Hong Kong residents.

中共建政71周年,也是中國人民飽受苦難的歷史。建政前,中共以民主、自由、繁榮、富強的承諾,欺騙萬千愛國者為其拋頭顱、灑熱血。建政後首30年,階級鬥爭為綱,政治運動頻仍;經濟冒進失誤,赤地千里,餓殍遍野。接著的10年,推行經濟改革,但仍堅持獨裁專政,打壓人民訴求,導致胡耀邦、趙紫陽下台,更發生「六四」血腥鎮壓。「六四」後31年來,貪污腐敗猖獗,貧富兩極分化,弱勢社群備受壓榨,道德倫理殆盡,維權和異見人士被拘入獄,全國籠罩白色恐怖,人權蕩然。習近平專政下,14億人民仍活在沒有人權、沒有尊嚴中,有甚麼值得慶祝?
今天是中共所謂的「國慶」,但71年來,許多人只因表達政治立場慘遭拘禁和酷刑,直到今天,仍有不計其數人士因言獲罪,身陷囹圄。在這個令人憤慨而非喜慶的日子,支聯會等團體特別關注被所謂「危害國家安全」罪名拘押的中國和香港抗爭者,他們面對獨裁政權迫害,我們在香港也正經歷同樣命運。
對中國異見人士來說,中國政府以所謂「國家安全」為理由作出種種打壓,是每天不能承受的痛。今年,香港人失去法治和自由,自中央政府於6月30日強推《港區國安法》後,多名人士以所謂與「國安」有關的罪名被起訴,12位年輕人更因為逃亡台灣途中「被送中」,香港人自由岌岌可危,與中國異見人士更是唇齒相依。
他們代表不同年齡和不同背景人士對民主自由的渴求,在鐵幕高牆的國度仍不畏強權,以各種方式爭取民主和傳播尊重人權的訊息,但他們合法和合理的行動和訴求,卻被政權以違反所謂「國家安全」惡法無理打壓,他們的案件在中國只是冰山一角,深信還有不少被專制政權迫害而不知名的受害人。
港區《國安法》強推以來僅僅數月,言論自由空間不斷收窄,過往不少可以喊的口號和可以發起的行動,已被政府強詞奪理解讀為違反《國安法》,營造赤色恐怖,企圖噤聲,打壓異己,令香港的自由急速消逝,嚴重侵犯市民的言論自由與集會自由。
我們強烈要求中國政府和香港政府停止粉飾太平,回應以下訴求:
1)平反八九民運,還多年來承受失去至親一個公道!
2)成立獨立調查委員會,調查「六四」及香港自去年「反送中」運動的警暴行為!
3)停止假借「國家安全」名義,肆意破壞香港法治精神和打壓言論自由!
4)立即釋放中港被囚異見人士!

’Without human Rights, How Can We Celebrate “National Day”?Stop the crackdown on dissidents; give us our freedom‘

The Chinese Communist Party has been in power for 71 years now—71 years of suffering for the Chinese people. Before coming to power, the Party promised to make China a democratic, free, prosperous and strong country, but it fooled hundreds of thousands of patriots into sacrificing themselves for the nation. For the first 30 years after the establishment of the regime, class struggle was the main focus and mass political campaigns were frequent. Economic policy was poorly devised, leading to famine and death.
In the following 10 years, the regime enacted economic reform but remained totalitarian. It cracked down on demands for change, leading to the fall of liberal state leaders Hu Yaobang and Zhao Ziyang and eventually the bloodshed of the 1989 Tiananmen Massacre. In the subsequent 31 years, corruption has been rampant and uneven wealth distribution serious. Underprivileged groups are squeezed by those in power. Ethics and morality have collapsed. Human rights defenders and dissidents are detained and imprisoned. The whole country lives under white terror. There are simply no human rights. Under Xi Jinping’s dictatorship, 1.4 billion people are living in a society without human rights or dignity. What is there to celebrate?
Today is what the Party calls “National Day”. But over the past 71 years, many have been ruthlessly imprisoned and tortured simply for expressing their political views. Countless people are still detained for their speech. On this day we should feel outrage rather than joy,. Hong Kong Alliance in Support of Patriotic Democratic Movements of China and other organizations are particularly concerned about the Chinese and Hong Kong activists facing so-called “national security” charges. While those in China endure the persecution of a totalitarian regime, we in Hong Kong experience the same fate.
Chinese dissidents suffer unbearable pain every day as the Chinese government uses the pretext of “national security” to crack down on them. In this year, Hongkongers have lost rule of law and experience diminishing freedoms. Since the central government forcibly imposed the Hong Kong national security law (officially the “Law of the People’s Republic of China on Safeguarding National Security in the Hong Kong Special Administrative Region”) on 30 June 2020, dozens of individuals have been charged with so-called “national security” crimes. Twelve young people fleeing to Taiwan were taken to China. Hong Kong people’s freedoms are at greater risk than ever. Hong Kong people’s fate is even more interconnected with the Chinese people’s.
Many, diverse in age and background, desire democracy and freedom. They do not fear challenging the government despite dictatorship. They fight for democracy and share information about human rights. But their legal and legitimate actions and demands have been punished by the government with so-called “national security” charges. Their cases are only the tip of the iceberg in China. There are many unknown people persecuted by the regime.
The Hong Kong national security law has been in force for several months. Freedom of expression is drastically diminishing. Protest slogans are now interpreted by the Hong Kong government as violations of the national security law. The government creates red terror, attempts to silence dissenting views, and cracks down on dissidents. Hong Kong’s freedoms are quickly disappearing. Hong Kong people’s freedom of expression and freedom of assembly are seriously infringed.
We call on the Chinese and Hong Kong governments to stop whitewashing the daunting situation in China and Hong Kong and respond to the following requests:
1. Vindicate the 1989 pro-democracy movement and give victims’ families a fair explanation, apology and compensation;
2. Establish an independent commission to investigate the Tiananmen Massacre as well as police violence during the Anti-Extradition Bill protests in Hong Kong since last year;
3. Stop using “national security” as an excuse to ruthlessly destroy Hong Kong’s rule of law and freedom of expression;
4. Immediately release all detained Chinese and Hong Kong dissidents.
