เจ้าหน้าที่ระดับสูงจีน Lai Xiaomin รับสินบน 9 พันล้าน ถูกประหารชีวิต /โดย ลงทุนแมน
ประธานาธิบดีสี จิ้นผิง แห่งประเทศจีนได้เอาจริงเอาจังกับการปราบปรามคอร์รัปชัน มาตั้งแต่เริ่มเข้ารับตำแหน่งเมื่อปี 2012

“Lai Xiaomin” ถือเป็นหนึ่งในเจ้าหน้าที่ระดับสูงของพรรคคอมมิวนิสต์แห่งประเทศจีน ที่ถูกสอบสวนและพบว่าเขารับสินบนเป็นมูลค่าเกือบ 9 พันล้านบาท ตลอดช่วงที่อยู่ในตำแหน่งมายาวนานถึง 10 ปี
ซึ่งการทุจริตดังกล่าว ได้นำไปสู่การที่เขา ถูกตัดสินประหารชีวิตเมื่อต้นปีที่ผ่านมา

Lai Xiaomin เกิดเมื่อปี 1962 ที่มณฑลเจียงซี ประเทศจีน

เขาเกิดในครอบครัวที่ค่อนข้างยากจน เขาจึงมุ่งมั่นตั้งใจเรียน จนในปีที่สอบเข้ามหาวิทยาลัย เขาสามารถทำคะแนนได้เป็นอันดับ 1 ของประเทศ และเลือกเรียนเศรษฐศาสตร์ที่ Jiangxi University of Finance and Economics

เมื่อเรียนจบ นาย Lai ก็ได้เข้าทำงานในสถาบันการเงินชั้นนำของประเทศ ตั้งแต่ธนาคารกลางจีน หรือ PBOC ต่อด้วยคณะกรรมการกำกับดูแลภาคธนาคาร หรือ CBRC รวมถึงเขาก็ยังเป็นสมาชิกพรรคคอมมิวนิสต์แห่งประเทศจีนอีกด้วย

ปี 2009 นาย Lai ย้ายมาที่ “บริษัทจัดการสินทรัพย์ Huarong” และได้รับตำแหน่งประธานคณะกรรมการ
ในอีก 3 ปีถัดมา

จนกระทั่งในปี 2018 เขาก็ถูกสอบสวน ซึ่งเป็นผลมาจากการปราบปรามคอร์รัปชันในหมู่เจ้าหน้าที่ระดับสูงของประธานาธิบดีสี จิ้นผิง และผลการสอบสวนก็พบว่านาย Lai มีความผิดอยู่ 3 อย่าง

ข้อหาแรก “การยักยอกทรัพย์” โดยนาย Lai ยักยอกทรัพย์เป็นเงิน 25 ล้านหยวน หรือกว่า 127 ล้านบาท ในทรัพย์สินที่เป็นของรัฐ

ข้อหาที่สอง “การสมรสซ้อน” โดยนาย Lai จดทะเบียนสมรสซ้อนและอยู่ร่วมกันฉันสามีภรรยา รวมถึงมีลูก กับทั้ง 2 ครอบครัว

นอกจากนี้ยังพบว่าเขามีภรรยาน้อยร่วม 100 คน ซึ่งส่วนใหญ่จะได้รับตำแหน่งระดับบริหารในบริษัทย่อยของ Huarong

ข้อหาที่สาม และเป็นข้อหาที่ร้ายแรงที่สุดคือ “การรับสินบน” โดยนาย Lai รับสินบนมาเป็นเวลากว่า 10 ปี หรือตั้งแต่ปี 2008 ถึง 2018 เป็นเงินกว่า 1.8 พันล้านหยวน หรือราว 9 พันล้านบาท

ซึ่งในช่วงสอบปากคำ ก็พบว่านาย Lai มีทั้งรถหรู อะพาร์ตเมนต์หรู นาฬิกาหรู งานศิลปะ และทองคำแท่ง ที่รับเป็นสินบน

นอกจากนี้ พอเจ้าหน้าที่ไปตรวจสอบที่อะพาร์ตเมนต์แห่งหนึ่งในกรุงปักกิ่ง ซึ่งนาย Lai ตั้งชื่อเล่นว่า “ซูเปอร์มาร์เก็ต” เจ้าหน้าที่ก็ได้พบตู้ขนาดใหญ่หลายตู้ ที่อัดแน่นไปด้วยเงินสดมูลค่ากว่า 1 พันล้านบาท

เรื่องราวของนาย Lai ได้สร้างความฮือฮาไปทั่วทั้งประเทศจีน รวมถึงได้รับความสนใจจากสื่อต่างประเทศ

เพราะแม้การรับสินบนจะไม่ใช่เรื่องใหม่ แต่มูลค่าการรับสินบนกว่า 9 พันล้านบาทนั้น
เป็นมูลค่ามหาศาล ที่ไม่เคยเกิดขึ้นมาก่อนในประเทศจีน

เรื่องนี้ก็สร้างความฮือฮาอีกครั้งเมื่อวันที่ 5 มกราคม 2021 ที่ผ่านมา
ที่ศาลประชาชนจีนตัดสินให้นาย Lai มีโทษถึงการประหารชีวิต

แม้ว่าตามกฎหมายของจีน การคอร์รัปชันที่เกี่ยวข้องกับเงินมากกว่า 3 ล้านหยวนหรือราว 15 ล้านบาทขึ้นไป จะมีโทษประหารชีวิต

แต่การพิพากษาโทษประหารจากความผิดลักษณะนี้เคยเกิดขึ้นน้อยมากและจะสามารถขอลดโทษเป็นจำคุกตลอดชีวิตได้ในภายหลัง

แต่กรณีของนาย Lai แม้ว่าตัวเขาเองจะให้ข้อมูลที่เป็นเบาะแสสำหรับการสืบเรื่องคอร์รัปชันอื่นต่อเนื่อง คำสั่งศาลสูงสุดก็ยังคงให้ประหารชีวิต

โดยศาลให้เหตุผลว่าการรับสินบนของนาย Lai ถือเป็นอาชญากรรมทางการเงินที่รุนแรงมากที่สุดครั้งหนึ่งในประวัติศาสตร์ สร้างความเสียหายให้กับสังคมเป็นวงกว้าง และคุณงามความดีที่นาย Lai เคยทำไว้ก็ไม่เพียงพอที่จะช่วยบรรเทาความผิดนี้ได้

นั่นจึงทำให้นาย Lai ในวัย 58 ปี ถูกประหารชีวิตเมื่อวันที่ 29 มกราคม 2021 หรือเพียง 24 วันหลังจากการพิพากษาในครั้งแรก และถือเป็นเจ้าหน้าที่ระดับสูงที่รับโทษรุนแรงที่สุดจากการคอร์รัปชัน

และแม้ว่าศาลจะพิพากษาให้ชีวิตของนาย Lai จบลง
แต่ความเสียหายจากสิ่งที่เขาทำไว้ กลับเพิ่งเริ่มต้นขึ้นเท่านั้น

บริษัทจัดการสินทรัพย์ Huarong ที่นาย Lai เป็นประธานคณะกรรมการอยู่ก่อนจะโดนสอบสวน คือหนึ่งใน บริษัทบริหารจัดการหนี้ด้อยคุณภาพที่ใหญ่ที่สุดของประเทศจีน โดยมีกระทรวงการคลังเป็นผู้ถือหุ้นใหญ่อยู่ 57%

Huarong เริ่มก่อตั้งในปี 1999 พร้อมกับอีก 3 บริษัท เพื่อจัดการปัญหาหนี้เสียในภาคธนาคารของประเทศจีนที่เป็นผลมาจากวิกฤติการเงินในเอเชีย

แต่เมื่อนาย Lai เริ่มเข้ามาบริหารในปี 2012 รูปแบบกิจการของ Huarong ก็เพี้ยนไปจากเดิม

เพราะนอกจาก Huarong จะเป็นบริษัทจัดการหนี้เสีย นาย Lai ยังได้ขยายธุรกิจเพิ่มเติมโดยรุกเข้าสู่ ธุรกิจการปล่อยสินเชื่อ ลีสซิ่ง โบรกเกอร์ซื้อขายหุ้น อสังหาริมทรัพย์และทรัสต์ วาณิชธนกิจรวมถึงประกัน

เมื่อขยายธุรกิจไปมากขนาดนี้ สิ่งที่ตามมาก็คือการหาเงินทุน ซึ่งนาย Lai ก็ได้นำ Huarong ระดมทุนผ่านตลาดตราสารหนี้ อย่างเช่น การออกพันธบัตรมูลค่ามหาศาล ทั้งในประเทศที่เป็นสกุลเงินหยวนและในต่างประเทศที่เป็นสกุลเงินดอลลาร์ฮ่องกงและดอลลาร์สหรัฐ

นอกจากนั้น Huarong ยังระดมทุนผ่านทางตลาดทุนโดยเข้าจดทะเบียนในตลาดหลักทรัพย์ฮ่องกงเมื่อปี 2015 ซึ่งสามารถขายหุ้น IPO กว่า 7 หมื่นล้านบาทให้กับสถาบันการเงินชั้นนำ เช่น Goldman Sachs, BlackRock และ Vanguard รวมถึงกองทุนระดับประเทศอย่างกองทุนความมั่งคั่งแห่งชาติของมาเลเซีย

ในฝั่งของผู้ที่มาซื้อพันธบัตรหรือมีสถานะเป็นเจ้าหนี้ของ Huarong ก็มีทั้งสถาบันการเงินและบริษัทขนาดใหญ่ที่เป็นของรัฐในประเทศจีนเอง รวมไปถึงนักลงทุนสถาบันในต่างประเทศด้วยเช่นกัน

Huarong จึงกลายเป็นหนึ่งในลูกหนี้รายใหญ่ ที่สามารถระดมทุนจากสถาบันทั้งในและต่างประเทศได้มหาศาล เพราะ Huarong มีรัฐบาลเป็นเจ้าของ จึงทำให้มีความน่าเชื่อถือสูงและด้วยเหตุผลเดียวกันนี้ก็ทำให้ต้นทุนการกู้ยืมของ Huarong อยู่ในระดับต่ำได้นั่นเอง

หลังจากนาย Lai พ้นจากตำแหน่งในปี 2018 Huarong ก็ได้แต่งตั้งผู้นำคนใหม่ที่ชื่อว่า Wang Zhanfeng โดยมีเป้าหมายหลักก็คือเข้ามาปรับโครงสร้างบริษัท Huarong ให้กลับสู่สภาพเดิมด้วยการเลิกทำธุรกิจส่วนที่ขาดทุนและที่ไม่ใช่ธุรกิจหลักเดิมของ Huarong

ซึ่งระหว่างที่กระบวนการปรับโครงสร้างดำเนินไป ผลกำไรสุทธิของ Huarong ก็ลดลงกว่า 94% ภายใน 2 ปี หรือระหว่างปี 2017 ถึง 2019

แต่แล้วเมื่อวันที่ 1 เมษายนที่ผ่านมา Huarong แจ้งว่าไม่สามารถส่งงบการเงินและรายงานประจำปีของปี 2020 ได้ทัน ซึ่งก็ได้ขอเลื่อนการส่งเอกสารทั้งหมดนี้ออกไปก่อน โดยอ้างว่าผู้ตรวจสอบบัญชียังต้องใช้เวลาตรวจสอบเพิ่มเติม

ซึ่งเหตุการณ์นี้ก็ยิ่งมาซ้ำเติม Huarong เข้าไปอีก จากสถานการณ์ย่ำแย่มาตั้งแต่ตอนที่นาย Lai ถูกจับกุมอยู่แล้ว

สถานะทางการเงินของบริษัทแย่ลงมาอย่างต่อเนื่อง จนเกิดเป็นความคลุมเครือในปีล่าสุด ที่ได้สร้างความกังวลในตลาดการเงิน เพราะโอกาสที่ Huarong จะไม่สามารถจ่ายหนี้จำนวนมหาศาลคืนได้ ก็มีมากขึ้น

โดยเฉพาะในตลาดตราสารหนี้ ที่ในปัจจุบัน Huarong มีพันธบัตรที่ยังไม่ครบกำหนดชำระคืน หรือ Outstanding Bonds มูลค่ารวมกว่า 1.4 ล้านล้านบาท

โดยครึ่งหนึ่งเป็นพันธบัตรที่ออกเป็นสกุลเงินหยวน อีกครึ่งหนึ่งออกเป็นสกุลเงินต่างประเทศ และ 1 ใน 10 ของมูลค่าพันธบัตรทั้งหมดที่กล่าวมานี้ Huarong มีกำหนดชำระคืนภายในปีนี้

ความกังวลนี้ก็สะท้อนไปที่ราคาของพันธบัตรของ Huarong ที่ผันผวนอย่างรุนแรงในไตรมาสที่ 2 และลามไปถึงตราสารหนี้ของบริษัทขนาดใหญ่อื่น ๆ ในประเทศจีนด้วย

ประกอบกับในช่วงที่ผ่านมา การผิดนัดชำระหนี้พันธบัตรของบริษัทในประเทศจีน ก็เพิ่งทำจุดสูงสุดเป็นประวัติการณ์ ซึ่งก็ยิ่งเพิ่มความกังวลในตลาดตราสารหนี้ของจีนมากขึ้นไปอีกว่าสถานการณ์จะรุนแรงจนทำให้เกิดเป็นวิกฤติการผิดนัดชำระหนี้ได้

ถึงแม้ว่าการผิดนัดชำระหนี้โดยบริษัทขนาดใหญ่ที่เป็นของรัฐแบบ Huarong จะยังไม่เคยเกิดขึ้นมาก่อนในประเทศจีน

แต่ถ้าเกิดขึ้นจริง ผลกระทบก็จะไม่ได้สร้างความเสียหายให้ตลาดตราสารหนี้จีนเท่านั้น แต่จะลุกลามไปทั่วโลก

เรื่องนี้ก็ต้องติดตามกันต่อไปว่า Huarong ที่เริ่มก่อตั้งมาเมื่อ 22 ปีก่อน
เพื่อบรรเทาและแก้ไขผลกระทบจากวิกฤติการเงินในเอเชียให้กับภาคธนาคารในประเทศจีน
จะให้ผลในสิ่งตรงกันข้ามและกลายเป็นต้นตอของวิกฤติครั้งใหม่ของประเทศหรือไม่..

I was attacked on messenger yesterday, by some guy who went through my FB stories and decided that one of the Tiktok videos that I shared was racist or offensive or something. The way he wrote to me was as if he was a disgruntled authority figure, and I was some heathen that had no inkling of what was right and wrong. I tried to remain polite. I even told him a little lie about appreciating his feedback. But he was unrelenting. The endless palaver became exceedingly tiresome.

Yeah, the Tiktok I shared on my story DID border on bad taste. It was gallows/morbid humor. Some people like it. Some don't. But anyone with half a brain would've known it was in jest. I can't help it that he was offended by a Tiktok. It's not like I threw it in his face. This is not something that shows up on his newsfeed either. He actively went on to my stories to view it. I told him that I didn't agree with his opinion. But he refused to let it go, so I reasoned that if he didn't like it, he shouldn't watch. Or he could unfollow me. Or even better, he could choose to unfriend me. He was still unhappy, so I told him, "Never mind, I'll do it for you.". And I blocked him.

Next thing I knew, he went on my Instagram to attack me because he was so aghast that I had the audacity to block him. He tagged me on stories and called me a "piece of shit" yadda yadda yadda and urged his friends to unfollow me. I can't remember what else he said. So I had to report him on Instagram and his stories were quickly taken off. It was just all a lot of bother for something petty that could have totally been avoided.

I'm an adult. And I am adequately intelligent. I know what's appropriate and what's not, and I know what's funny and what's not. And I don't expect everybody to agree with me. But I will not be "schooled" by some uneducated rube from God-knows-where, who can't even string a coherent sentence together.

Also, anyone who dislikes me or my stories or my posts really doesn't have to tolerate any of it. They can exercise their God-given right to unfollow me or unfriend me, or even block me. It's as simple as that.
