馬來西亞响2019年12月18號向聯合國提出，反對南海島礁變人工島嘅提案，之前已經得到印尼、菲律賓、越南同澳洲支持。

今日輪到英、德、法三國共同向聯合國書面回覆，反對中國响南海呢類非法海事活動。

美國總統歐巴馬20日頒布了一項永久的新禁令，禁止美國在大西洋及北極海域進行石油和天然氣的探鑽，而這項禁令影響了阿拉斯加外海 (Chukchi Sea)1.15億英畝的美國聯邦水域、幾乎整個Beaufort Sea和新英格蘭(New England)範圍內380萬英畝的海域。

【對 EEZ 應有的認識】

在南海仲裁出爐之後，由於目前由台灣治理當局實質管理的 Itu Aba 的位階由島降為礁，導致喪失主張專屬經濟海域 (EEZ) 及大陸棚 (continental shelf) 權利的資格。而專屬經濟海域也成為一熱門詞彙。
　
不過在探討為何 Itu Aba 由島降級為礁的問題時，我們注意到有人認為：
「Itu Aba 之所以會被降級，
　是因為若以其為中心 200 浬為半徑劃圈，
　會涵蓋其他國家的領土、領海，
　所以 Itu Aba 被降級是必然的結果。」
　
遺憾的是，這樣的論述是出自於對 EEZ 性質及海洋法在處理權利重疊問題時的原則不了解所致，因此並不正確。
　
在此，必須先建立的基本觀念是：
　
「200 浬只是『理論上』可主張 EEZ 的最大範圍」，
　
實際上，由於自然地理條件的限制、國際法上「主權平等」原則以及國際間政治角力的影響，儘管「『理論上』可以主張 200 浬 EEZ」，但不一定「『真的』可以主張 200 浬 EEZ」，而且相關當事者也沒有任何「必須主張 200 浬 EEZ」的義務。
　
而此次成為討論核心的南海，正是一個：
「因為狀況過於複雜，
　所以即使是自認擁有域內島嶼主權的各方勢力
　也都『選擇不主張、不劃定』EEZ 的特殊地區。」
　
因此，在南海相關勢力皆未劃定 EEZ 的情況下，Itu Aba 由島降為礁，嚴格說起來，並沒有對台灣在相關海域的經濟利益造成任何影響。但這是否代表 Itu Aba 由島變礁完全沒有影響到權益呢？
　
其實還是有的。
　
畢竟，如果 Itu Aba 是島，就「可以主張 EEZ」，可合法管領 Itu Aba 的勢力就有「選擇主張/不主張的權利」。但如果是礁，就「不能主張 EEZ」，就算想「選擇主張 EEZ」也沒有機會。而在談判上，「擁有選擇的權利」就是一個重要的談判籌碼。
　
所以，Itu Aba 如果是島，對於沒有 Itu Aba 主權但有合法代管權限的台灣治理當局來說，在為台澎代管區漁民與跟周遭國家進行漁權談判時，當然還是比較有利的。
　
　
那麼，撇開 Itu Aba 的狀況不談，假設今天在劃定 EEZ 的時候，發生 EEZ 將其他國家的領土、領海包進去，或跟其他國家的 EEZ 重疊的情形該怎麼辦呢？
　
其處理原則基本上是這樣的：

一、EEZ 不得侵犯領土、領海。
　
1.由於 EEZ 實際上是附屬於臨海領土的延伸權利，所以在權利強度上，領土權優先於 EEZ。因此，劃定 EEZ 時不能將他國領土劃入。當然，劃入也沒有用，因為 EEZ 的目的在於海洋及海底資源的運用，將無法行駛船艦的陸地劃入 EEZ 沒有任何意義。

2.在海洋法中，領海是領土的延伸，領海擁有者以外的人僅能以無害通過 (innocent passage) 為由取道經過，利用海洋資源當然在禁止之列。所以在權力運用上，即使將他國領海劃入 EEZ，也會因為領海擁有國可以行使武力排除非無害通過的利用行為而無任何實質意義。

3.實際例子可舉尼加拉瓜 (Nicaragua) 為例（參見圖一）：

圖一是尼加拉瓜 (Nicaragua) 的 EEZ，我們會注意到 EEZ 右邊的形狀非常不規則，尤其是右邊中間偏上出現兩個洞（橘色箭頭指示處）。
　
為什麼會這樣呢？
　
這是因為在尼加拉瓜 EEZ 的 200 浬範圍的那個地方，出現了屬於哥倫比亞 (Columbia) 的聖安德列斯-普羅維登西亞和聖卡塔利娜群島
(Archipielago de San Andrés, Providencia y Santa Catalina) 的礁岩。而這兩個圈圈就是這些礁岩的領海在尼加拉瓜 EEZ 上製造出來的缺口。
　
　
二、EEZ 重疊時，應透過協商機制議定界線。而依國際慣例，劃定界線時除有特殊約定外，原則上是採用中線 (median line) 原則。

1.基於主權平等原則，國際法上在劃定界線時，除非有特殊情形而另行以國際文書約定（例如基於政治考量、安定性的考量、對過往條約的尊重），否則原則上會採用中線原則，EEZ 當然也不例外。

2.實際例子可以馬達加斯加周邊法屬群島的 EEZ 為例（參見圖二）：

圖二是馬達加斯加 (Madagascar) 周圍法屬群島的 EEZ。圖中央那個島就是馬達加斯加，左右兩側深紅色部分是法屬島嶼的 EEZ。我們會注意到這些島嶼的 EEZ 跟馬達加斯加 EEZ 間的分隔線（橘色箭頭指示處）是藍色的，
　
而在此圖中，藍色線段代表中線 (Median Line)。
　
從上述兩個實際發生的例子我們可以瞭解到：

即使 Itu Aba 是可以主張 EEZ 的島，在畫定其 EEZ 時，也不可能將其他國家的領土、領海、EEZ 全部劃歸己有。國際法自有規則來處理，不可能出現這種荒謬的狀況。
　
換句話說，Itu Aba 會從島變成礁，並不是因為它的 EEZ 會將其他國家的領土、領海、EEZ 都變成自己的，因為實務上法律上根本不可能發生這種效果，所以這不會是原因。

Itu Aba 會由島變成礁，主要關鍵還是在於此次南海仲裁庭定下了島與礁的明確區分標準，亦即：是否存在「穩定定居的人類社群」。而依照該標準，必須靠外界資源援助無法自力更生的 Itu Aba 並不是島。至於這個判定島/礁的標準是否合理，還有待日後國際社會的反應來確定。
　
　
最後，從「對南海內島嶼沒有人主張 EEZ」的現況看 Itu Aba 的地位變動，就跟從「台灣沒加入聯合國」的現實看台灣建國是一樣的。
　
雖然連實質合法管理 Itu Aba 的台灣治理當局都沒有主張 EEZ，主張 EEZ 之後能發揮多大作用也不清楚，但在為台澎代管區爭取權益上，擁有「選擇是否主張 EEZ 的決定權」終究還是比「沒有」多出一些籌碼。所以如果 Itu Aba 被認定是島，當然比被認定是礁好。
　
　
台澎建國也是一樣的。
　
台澎如果完成了自決建國程序，就擁有「選擇是否加入 UN 的選擇權」。雖然到時候申請加入 UN 能否順利還不清楚，但能擁有「選擇是否加入 UN 的決定權」當然比連國家都不是，想加入都沒得加入的「現況」要好上許多。
　
但如果台澎住民繼續把中（華民）國當成自己的國家，進而繼續把中（華民）國政府於 1947 年所公布，也就是它還是世界公認的「中國政府」時所公布的「南海諸島位置圖」當成自己在南海的主權主張，終究只會讓台灣被全世界都視為中國的台灣當局 (Taiwan Authority of China) 而已。
　
　
別再耽溺於中（華民）國了，對台澎住民人來說那不是美夢只是噩夢，快自決建國吧！

Asia is the largest of all continents, covering an area of 44,579,000 square kilometres, that's 30% of the Earth's total land area.

It has given rise to many of the world's first civilizations, and has long been home to the majority of the human population.

But have you ever wondered what actually counts as Asia? Where exactly are the borders?

Do they sit nicely in between countries, or can a country be divided?

This video is part three of a three part series. We cover the specific Asian borders between Northeast Asia and North America.

[WHERE ARE THE ASIAN BORDERS? (PART 2: EUROPE)]

Asia is the largest and most populous continent in the world. From the physical extremes to the cultural, it's a continent that has shown tremendous diversity from one end to the other.

But what exactly counts as Asia? Where are the Asian borders?

This video is part two of a three part series.

In part one, we covered the specific Asian borders following the coastal regions from the Tumen River between North Korea & Russia to the Suez Canal in Egypt.

In between, we went over Japan's Bonin (Ogasawara) Islands, the Malay Archipelago, Indonesia's border with Papua New Guinea, the Wallace Line, the Weber Line, Asian continental shelf, the Middle East, Yemen's Socotra Archipelago, Afro-Eurasia and Egypt's border.

In part two, we cover the most controversial Asian border section of Europe starting from Egypt, through Lebanon, Syria, Cyprus, Turkey, Georgia, Azerbaijan, Kazakhstan and Russia. We end on the eastern side of Russia (Siberia) bordering North America, which is where part three will commence.

Many feel Asian and Europe shouldn't have been separate continents to start with, as there isn't a clear physical geographical divide between the two. In fact, a few countries teach the continent of Eurasia as a result. This made this video particularly challenging as nothing is definitive and is all open to interpretation.
