[English Translation of Petition]
Safeguard Hong Kong, No More Suppression on Human Rights!
We are a group of Hongkongers living in Germany. Due to the out-of-hand violence of the Hong Kong Police Force (hereinafter referred to as the "HKPF"), the social movement in Hong Kong has turned into a humanitarian disaster. We call on the Federal Republic of Germany (hereinafter referred to as the “Federal Government”) to provide emergency assistance and we urge the Federal Government to take immediate and practicable action.
Abusive use of weapons and dereliction of duty by HKPF:
1. Protesters and passengers were assaulted by suspected triad groups in metro stations, and police only arrived 40 minutes after reports were made (Yuen Long MTR station on 21 July; similar attacks happened in Tsuen Wan and North Point on 5 August and 11 August respectively)
2. Mishandling a teenage female protester by male police officers, exposing her body parts during the arrest (Tin Shui Wai on 4 Aug)
3. Manipulation and deliberate planting of evidence (eg. putting sharp bamboo stick into protester’s backpacks, unsealing evidence bags that should remain sealed until presented at court)
4. 3 Members of Legislative Council, and more student activists were arrested by the police and 2 organizers of demonstrations were attacked by thugs on 30 August which is the eve of a massive demonstration
5. Police stormed the metro station, beat protesters and passengers in the station and on the train, closed all the exits and then expel all reporters and first-aiders from the metro station (Prince Edward MTR station on 31 Aug)
CALL FOR ACTIONS
In order to protect German expatriates and the interests of German enterprises in Hong Kong, as well as to protect the human rights of EU citizens in Hong Kong, we urge the Federal Government to consider taking the following actions:
1. Halt all export of crowd control equipment and “less-lethal” weaponry to Hong Kong Police Force (HKPF)
2. Express concerns regarding the escalating tension in Hong Kong and safety of German expatriates in Hong Kong
3. Deploy official Human Rights Observer to Hong Kong and to make an independent observation at the frontline
4. Acknowledge that protesters in Hong Kong may be persecuted on political grounds and adjust its asylum policy to Hong Kong asylum seekers
5. Halt any cooperation and exchange programme with the HKPF
6. Forbid entry into the EU / Revoke the right of abode or EU citizenship (if any) / Freeze the assets in EU of senior officers of Hong Kong Government and pro-China legislators and their immediate family members (if any)

《致香港大學李嘉誠醫學院院長、中文大學醫學院院長的公開信》
梁教授、陳教授道鑒:
有鑑於在六月十二日、七月二日及二十一日,香港警察濫用武力以控制群眾。如此行徑實對公眾健康遺害無窮,我們一眾醫療人員對此極為關切。作為香港大學李嘉誠醫學院院長、中文大學醫學院院長,吾等懇請兩位院長細察香港警察控制群眾之手段,以保障公眾健康。
據多家本地及國際媒體報導,香港警察於六月十二日,發射多輪催淚彈、橡膠子彈及布袋彈,以驅散聚集在金鐘的示威者。報導提及,警方向示威者發射至少一百五十枚催淚彈,二十輪布袋彈以及數枚橡膠子彈,造成至少七十二人受傷。從多家媒體直播可見,橡膠子彈更直射一名教師眼球,創傷嚴重,對其視力之損害非同等閒。另外,警方亦曾以數枚催淚彈包抄示威者,堵塞其退路;而當示威者被逼退守至中信大廈,警方竟朝人群中央投以催淚彈,造成數以百計的市民受傷及呼吸困難,生死攸關,不容小覷。此外,警方向一名手無寸鐵的市民,近距離發射橡膠子彈,以致其下腹嚴重受傷,情況慘不忍睹。
據多份醫學期刊綜述──如《刺針》(Lancet)[1] 及英國醫學期刊(BMJ (Open))[2],橡膠子彈乃可致命武器。同時,橡膠子彈不易操控,準確性低,有引致重傷,乃至死亡之風險。多份期刊不約而同指出,橡膠子彈不適宜用於密集人群之管制。
然而,香港警察漠視上述已知風險,仍於七月二日及七月二十一日繼續使用此類武器。在七月二十一日,警察更於鄰近民居之地,向群眾發射多輪催淚彈及橡膠子彈,當中更殃及記者。此等武器之禍害影響深重,不單有損呼吸系統,更會導致燒傷、嚴重鈍物創傷及爆炸性創傷。據媒體報導,武器造成至少十四人受傷;更有市民懼於警方之搜捕行動,而未敢求醫,致使受傷數字難以估算。
人權醫療組織(Physicians for Human Rights)醫生哈爾(Dr Rohini Haar)在接受紐約時報訪問時指出,警方對市民使用不成比例的武力,實有濫用武力之嫌。早在二零一四年,潘冬平教授[3]亦對香港警察使用催淚氣體情況深表關注,擔心催淚氣體損害市民呼吸系統。可見,催淚彈、橡膠子彈及豆袋彈等武器危害不輕,對香港市民公眾健康的損害不容置疑。
兩大醫學學院一直致力培育杏林菁英,不遺餘力。一眾醫療人員亦謹承《希波克拉底誓詞》之教誨,不論病患身份職要,一直為全人類之福祉著想,嚴守不懈。學院循循善誘,吾等縷心刻骨。誓詞薪火相傳,代代不息;缺少對生命健康之尊重,醫療人員何以自立?故此,我們一眾醫療人員懇請院長,發表聲明,呼籲香港警察:
一、避免濫用催淚彈及任何類型子彈,以免導致人命傷亡及其他不可見之損傷。
二、在使用武力時,必須顧及市民安全,並保持專業克制。
醫療人員一直存仁心,行仁術;保護市民之健康,乃至生命,吾等責無旁貸。院長為學為醫,高風峻節,茍以吾等同心同德,捍衛市民之生命健康,必見杏林春暖。

Dear Professor Leung and Professor Chan,
We are a group of healthcare professionals, some of us being also graduates from the Faculty of Medicine of the University of Hong Kong and the Chinese University of Hong Kong. We are writing to express our gravest concerns over the persistent and serious threats to the health of members of the public posed by weapons deployed in crowd control by the Hong Kong Police Force (HKPF) on 12 June, 2 July and 21 July. We hereby urge the Deans of the sole Faculties of Medicine in Hong Kong to take actions in censuring the HKPF and the Hong Kong Government against the serious health risks in their crowd-control tactics.
On 12 June, as reported by multiple local and international news agencies, the HKPF fired multiple rounds of tear gas, rubber bullets and bean-bag rounds to disperse protesters in Admiralty. Over 150 canisters of tear gas, 20 bean-bag rounds and several rubber bullets have admittedly been directed at protestors which resulted in at least 72 injuries. As evident in the live reports from various media sources, a teacher suffered traumatic ocular injury causing significant vision loss when his eye was hit by a rubber bullet; hundreds of citizens suffered various degrees of injuries and respiratory distress consequential upon the numerous tear gas canisters shot at Citic Tower in Admiralty where protesters were trapped in a life-threatening space filled with tear gas; an unarmed man sustained injury in his lower abdomen when a rubber bullet was directed at him in a short distance.
According to multiple studies and reviews from high impact factor medical journals, in particular the Lancet[1] and BMJ (Open)[2], rubber bullets can be lethal. Their notorious inaccuracy and risk of severe injury and death render them inappropriate and unsafe means of force in crowd control.
However, despite the known risks of these weapons, the HKPF tenaciously deployed them on citizens on 2 July and 21 July. On 21 July, 55 canisters of tear gas, 5 rubber bullet rounds and 24 sponge bullets were admittedly shot, some without immediate warning, at protestors and even at journalists notwithstanding the numerous residential buildings and citizens in the vicinity. The use of these weapons has left members of the public with at the very least, various types of injuries and further, burns, blunt force trauma and explosive injuries. 14 injuries have by far been reported where others did not present themselves to the hospital in fear of the risk of prosecution.
Dr Rohini Haar of Physicians for Human Rights had in a recent interview told the New York Times that the force used by the HKPF was disproportionate and excessive. In Hong Kong, Professor Ronnie Poon had as early as in 2014 expressed openly his earnest concern over both the short term and long term health risks in the use of tear gas in particular to one’s respiratory system when the HKPF first fired tear gas at Hong Kong citizens [3]. It is indisputable that these named weapons put the health of Hong Kong citizens at serious risks.
Doctors have striven to stand by the Hippocratic oath that they remain members of society, the identity of which comes before their profession, with special obligations to all fellow human beings. The two medical schools in Hong Kong have been established accordingly for the nurture of healthcare professionals to serve the public with benevolent hearts and minds. This is the time to honour our oath that human life should deserve the utmost respect and to maintain by all means such noble traditions of the medical profession.
We, as healthcare professionals, therefore implore the Deans of the only Faculties of Medicine in Hong Kong, in the service of humanity with conscience and dignity, to take the lead in safeguarding the public’s health and to issue a statement to urge the Hong Kong Police Force to:
(1) refrain from using tear gas and bullets in any form on protestors to prevent further bloodshed and severe non-reversible injuries; and
(2) exercise due restraint over the use of force when handling protests and at all times, put the safety of Hong Kong citizens at the highest priority.

香港市民:
二零一六年農曆新年,政府一改慣例,將小販趕盡殺絕。港人因而聲援旺角新年小販,支持本土文化。豈料警方突然暴力清場,更向天鳴槍,終引發大規模警民衝突。港共政權以暴動罪起訴抗爭者,清算異己。過去兩年已陸續有抗爭者因暴動罪被判刑,抗爭者為爭取公義卻失去了數以年計的光陰,大專學界對抗爭者的遭遇表示痛心,並譴責港共政府無恥之舉。
昨天盧建民和梁天琦竟被分別判囚七年和六年,日前亦有抗爭者被判以數年計的監禁。大專學界認為近日判刑過為苛刻。香港法例早已變得因陋守舊。《公安條例》對暴動罪中「破壞社會安寧」並無清晰界定,而「非法集會」和「暴動」的定義亦無明確分野,兩者卻存在差天共地的量刑標準,讓法例淪為政權打壓抗爭者的工具。聯合國亦曾兩度批評現時《公安條例》並未能為市民集會自由提供足夠保障,唯香港仍然固步自封,迴避檢討《公安條例》。學界促請檢討現行法例,確保港人權利在維持社會秩序中亦有所保障。學界亦認為裁決和量刑考慮中,社會現況和抗爭者的動機意圖都是不可忽視的公共政策因素。若被告行動的意圖或動機是真誠追求社會利益而非個人利益,法律亦應予以考慮。
今天抗爭者身陷囹圄,我們更要去食存信,把抗爭者為我城鞠躬盡瘁的精神銘諸心腑。在當今專制政權之下,大專學界誓必與港人同行,以追求自由為志,銘記同儕犧牲,思考我城前路。佛朗士在《諸神渴了》中寫道:「當政府違反人民權利時,反抗乃為人民責任中最神聖、最不可缺少的。」赤化風暴從未止息,我城前路憂堪:一地兩檢、國歌法本地立法和廿三條立法等危機接踵而來。此刻我們決不可如槁木死灰,更不可視若無睹。作為香港人,我們不能把拯救我城的責任假手於人,也不應對我城未來失去希望。希望愈渺茫,我們愈要捉緊;唯有堅持,我們才有機會把握我城命運。

A Lost Battle Is A Battle One Thinks One Has Lost - A Letter to All Citizens of Hong Kong from Students’ Unions of Higher Institutions
Dear Hong Kong Citizens,
During the Lunar New Year of 2016, the government changed its usual practice and forbidden the hawkers to make their own living ruthlessly. Thus, in order to defend the local culture, Hong Kong people stood up and supported the hawkers in Mong Kok. Yet, the police suddenly arrived at the scene and evicted the protesters in violence. Worst still, they even fired bullets amidst the crowd. The clampdown eventually led to a large-scale conflict between police and protesters. In the past two years, there have been protesters prosecuted by the government and sent to prison for crimes such as riots. The Students’ Unions of Higher Education Institutions in Hong Kong would like to express our utter sadness towards the hardship suffered by the convicted and accused protesters in the Mong Kok Cases. Moreover, we hereby condemn the shameful act of the regime.
Apart from the seven-year and six-year imprisonments suffered by Lo Kin-man and Edward Leung, several protesters have also been sent to jail for years. The Students’ Union of Higher Education Institutions in Hong Kong would like to express our concern and discontent towards the oppressive and unreasonable sentences recently. In fact, the laws in Hong Kong have already become obsolete. In "Public Security Ordinance”, the meaning of "leading to a breach of the peace" is not clearly defined. Moreover, there is no clear distinction between the definitions of “Unlawful assembly" and "Riot”, but the criterions for imposing penalty are completely different for these two crimes. Such loopholes allow the regime to use laws as means to suppress the protesters. The United Nations has twice criticised that the current “Public Security Ordinance” does not provide citizens with sufficient protection to enjoy their freedom of assembly. However, the Hong Kong government evades reviewing the current "Public Security Ordinance”. We then urge for a review of the current laws to ensure that the rights of Hong Kong people are safeguarded while maintaining social order. We also believe that the current situation in the society, as well as the intention of the protesters, are public policy factors that cannot be ignored. Such intention should also be considered If the defendant strives to pursue social interests instead of self interests.
Today, protesters were imprisoned as they were prosecuted by the regime. We shall keep our faith despite the adversities, engraving the protesters’ spirit of sacrificing themselves for our city on our mind. Under the dictatorial regime, the Students’ Union of Higher Education Institutions in Hong Kong pledge to walk along with all citizens throughout the journey of pursuing freedom. We shall bear in mind the sacrifices of the predecessors and ponder over the future of our city. In “The Gods Are Athirst”, Anatole France wrote: “When the Government violates the Rights of the people, insurrection is for the people the most sacred and the most indispensable of duties.” Hong Kong has never escaped from the increasing control of the communist party, and its future is disconcerting as human rights and rule of law are being devastated. When various crises such as the co-location arrangement together with legislations of national anthem law and Article 23 come around incessantly, we shall never let our voice die down nor allow the regime to trample on us. It is only the Hong Kong people who bear the responsibility of saving our city. We shall never lose hope of the future of Hong Kong, as only through perseverance and assertiveness can we take control of the destiny of our home.
Jean-Paul Sartre once said, “a lost battle is a battle one thinks one has lost.” Shall we fight and struggle with persistence, Justice will return gloriously.
